These terms apply to every order placed on houseofmorka.com. We've kept them as short and plain as the law allows. If anything is unclear, write to info@houseofmorka.com before you order.
1. Who we are
House of Morka · K. Donelaičio g. 62, LT-44248 Kaunas, Lithuania · info@houseofmorka.com.
We design and sell custom pet portrait shirts, sweatshirts and hoodies, printed to order in Lithuania, and gift cards. "We" and "us" means House of Morka. "You" means the person placing the order.
2. What these terms cover
These terms, our Privacy policy, Shipping and Returns and refunds pages form the agreement between you and us. The version published when you place your order applies to that order. Our shop is for consumers; the terms are in English.
3. How ordering works
- Upload a photo of your pet and choose a style.
- We draw three sketches in about two minutes. You can draw more, pick the one you like, and enter your pet's name and any text the design allows.
- Choose the garment, colour, size and print position, and add it to your cart.
- At checkout you see the total price, including VAT and shipping, and can correct any detail before paying.
- When you click the payment button, you place a binding order with an obligation to pay.
- We send an order confirmation by email. The contract is concluded when you receive it. Your confirmation and the order history in your account are your record of the order.
Viewing and drawing sketches is free and does not oblige you to buy anything.
4. What you approve when you order
By placing an order you approve the sketch you picked, the spelling of the name and text, and the garment, colour, size and print position. Please check them carefully — we print exactly what you approved.
Before printing, a person checks every design and prepares the print file. We may make small technical adjustments so it prints well on fabric — position within the print area, contrast, cleaning up edges — without changing the design. If we spot a problem we can't fix that way, we write to you before printing.
A portrait is an artistic interpretation of your photo, in the style you chose. Colours on fabric can look slightly different from your screen, and printed details are softer than on a monitor. These are not faults.
5. How the sketches are made
Our styles are designed by our team. The sketches of your pet are drawn by image-generation software working from those style templates and your photo. A person reviews every design before it is printed.
6. Prices and payment
- Prices are in euros and include VAT. Shipping is added at checkout and shown before you pay (see Shipping).
- Multi-item discounts are applied automatically in the cart and shown before you pay.
- You can pay with the methods shown at checkout. Payment is taken when you place the order and processed by our payment providers; we never see your full card details.
- If a price on the site is obviously wrong because of a technical error, we'll tell you before printing and you can either accept the correct price or cancel for a full refund.
7. Delivery
We ship to all 27 EU countries. Delivery times and costs are on the Shipping page. Unless agreed otherwise, we deliver within 30 days of the contract.
8. Right of withdrawal
Personalised items
Every shirt, sweatshirt and hoodie we sell is made to your specifications and clearly personalised — your pet's portrait, the name and text you entered. For these items there is no right of withdrawal (Article 16(c) of Directive 2011/83/EU). If something is wrong with the item, section 9 applies.
Gift cards and other non-personalised items
For gift cards, and any item marked as not personalised on its product page, you have the right to withdraw from the contract within 14 days without giving any reason.
The withdrawal period ends 14 days after the day the contract is concluded (for a gift card) or 14 days after the day you, or someone you name, receive the goods (for a physical, non-personalised item).
To withdraw, use the withdrawal form on our site, or send us a clear statement by email to info@houseofmorka.com or by post to the address above. You can use the model form on that page, but you don't have to. It is enough to send your notice before the period ends.
Effects of withdrawal. If you withdraw, we refund all payments received from you for that contract, including the standard delivery cost, without undue delay and no later than 14 days from the day we are informed of your decision. We use the same payment method you used, unless you expressly agree otherwise; you won't pay any fees for the refund. For physical goods, we may wait until we receive them back or you show proof that you sent them, whichever comes first. You send the goods back within 14 days at your own cost, and you are liable only for any loss in value caused by handling them beyond what is needed to establish their nature, characteristics and functioning. A gift card is withdrawn only while it is unused.
9. Faults and your legal guarantee
You have the legal guarantee of conformity: we are responsible for any lack of conformity that exists at delivery and becomes apparent within two years. On top of that, we reprint free or refund faulty, damaged or wrong items reported within 30 days of delivery, without asking for them back. The details are on Returns and refunds.
10. Your photos and text
- You confirm that you took the photo you upload or have permission to use it, and that the name and text you enter don't infringe anyone's rights.
- You give us a free, non-exclusive permission to use your photo, the name and text, and the resulting design only to draw your sketches, make, print and deliver your order, handle support and reprints, and keep the records we have to keep. This ends when we delete them (see the Privacy policy).
- We never use your photo or your pet's portrait in our advertising, on our site or on social media without your separate, explicit consent.
- If your photo shows people, we only use the pet. Please upload photos without other people where you can.
- We may refuse or cancel, with a full refund, an order whose photo or text is offensive, hateful, sexual, infringes someone else's trademark, copyright or personal rights, or shows something that isn't a pet.
11. Our designs
The styles, templates, illustrations, texts, photos and the House of Morka name and logo belong to us or our licensors. Your printed item is yours to wear, gift and show off, and you're welcome to share photos of it. You may not resell the designs, reproduce them on other products or use them commercially without our written permission.
12. Gift cards
- Gift cards are sent by email and can be used for any product on houseofmorka.com, in one or several orders.
- They don't expire and can't be exchanged for cash, except where the law requires it.
- Treat the code like cash: anyone who has it can use it. We can't replace a code that someone else has used.
- If an order paid with a gift card is refunded, the amount goes back to the gift card.
13. Your account
You can order with or without an account. If you create one, keep your login details private and tell us if you think someone else has used them.
14. Liability
We are liable under the law for damage we cause intentionally or through gross negligence, and nothing in these terms limits liability for death or personal injury or your mandatory consumer rights. Apart from that, we are not liable for indirect losses that we could not reasonably foresee when you placed your order.
We are not responsible for delays or failures caused by events outside our reasonable control, such as courier strikes, natural disasters or major outages. If that happens, we tell you, and you can cancel for a full refund if the delay is long.
15. Complaints and disputes
If something isn't right, write to info@houseofmorka.com first. We reply within 14 days at the latest, usually within two working days.
If we can't solve it together, you can turn to the State Consumer Rights Protection Authority of Lithuania (Valstybinė vartotojų teisių apsaugos tarnyba, vvtat.lrv.lt), which handles consumer disputes out of court. If you live in another EU country, the European Consumer Centre in your country can help with cross-border complaints. You can also go to court.
16. Applicable law
These terms are governed by the law of the Republic of Lithuania. If you are a consumer living in another EU country, you keep the protection of the mandatory consumer laws of your country.
17. Changes to these terms
We may update these terms from time to time. The date at the top of the page shows the latest version. Orders are always governed by the version in force when they were placed.
